Child Relocation Case Study: Successful Outcome
Rafton Family Lawyers have recently been successful in a matter that involved the relocation of a child without consent from the Sydney Area to the Central Coast.
Rafton Family Lawyers were first consulted by the father of the child, who at that stage was four years, after he learned that the mother had relocated from the Blue Mountains region in Sydney up to the Central Coast, a travel distance of over 2 hours by car. The mother had notified the father of her move but did this only after she had left the region.
Our expert family law team were able to urgently take instructions from our client who was the father and bring an urgent application in the Federal Circuit and Family Court of Australia at Parramatta seeking the return of the child back to the Blue Mountains region. The matter first came before a Senior Judicial Registrar for an interim or urgent hearing and after hearing submissions and reading the evidence that we had prepared, an order was made for the child to be returned back to the area while the court properly reviewed the matter.
The matter then progressed through the court system and an expert report was prepared by a social worker in relation the impact on the child if the mother were permitted to move such a significant distance away. The matter then proceeded to a three day final hearing before a Judge in Division 2 of the Federal Circuit and Family Court of Australia. After hearing evidence over 3 days of hearing with Rafton Family Lawyers assisting in the preparation of the matter, the client has advised us that he was successful in preventing the child being relocated out of the area. This obviously was a very significant favourable outcome and the client was ecstatic.
