Rafton Family Lawyers Achieves Supreme Court Victory in Estate Case
The Team at Rafton Family Lawyers Wills and Estates have recently been successful in an Application to the Supreme Court which came before Chief Justice Hammerschlag in the Equity List. The case reference is the Estate of Smith [2024] NSWSC 568.
The decision was handed down after we were successful in making an application on behalf of our client (the executor of an estate) in relation to a Will that had been misplaced by a previous lawyer. At the time the executor was referred to our office there had been an attempt by a previous firm to obtain a Grant of Probate on behalf of the estate, but the significant delays had caused distress for the executor and beneficiaries, and they were referred to our expert team for further assistance.
We were able to successfully prepare and run the application before the Chief Justice and were successful the same day in having the Grant of Probate released so that our client could proceed and sell the property in the estate and obtain other funds from the Estate.
